Terms of Use

These terms apply to the Acceleration Directory (the “Directory”), a free service operated by Owlpine Group LLC(“Owlpine Group”, “we”, “us”). By creating a profile, logging in or using the Directory you agree to them. If you do not agree, please do not use the Directory.

1. What the Directory is

The Directory is a free, searchable listing of agents who represent talent and creators in action sports, motorsport and related fields, and the talent and creators they represent.

2. Who can use it

You must be at least 18 and have the authority to act for any business you list. Browsing the Directory does not need an account. Listing yourself does.

3. Your account and profile

• Give accurate information and keep it up to date. Keep your password secure; you are responsible for activity on your account.
• Every profile is reviewed before it appears. We may approve, reject, edit or remove a profile at our discretion, for example if we cannot confirm that it is genuine.
• The orange “A” badge means we have reviewed the agent’s profile. It is not a licence, certification or endorsement, and we do not guarantee any agent’s services, conduct or results.

4. Talent and creators you list

By adding talent or a creator to your profile you confirm that:

• you are authorised to represent them, or otherwise have their permission, for the information and images you add;
• you have the right to share the name, photo, Instagram handle and biography you provide; and
• the information is accurate and not misleading.

If you are talent or a creator listed without your permission, or you want your listing changed or removed, email contact@owlpinegroup.com and we will act promptly.

5. Your content

You keep ownership of what you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, display and distribute it in the Directory and to promote the Directory, for as long as it is listed. You must not submit anything unlawful, infringing, defamatory, hateful, deceptive or that you do not have the right to share.

6. Acceptable use

You agree not to:

• impersonate anyone, or list people you do not represent;
• send spam, bulk or unsolicited marketing, or harass other users, using the contact form or the details in the Directory;
• scrape, copy or compile the Directory, or use it to build a competing or marketing database, without our written permission;
• attempt to break, overload or gain unauthorised access to the Directory or its data; or
• use the Directory for anything unlawful.

7. Messages

Visitors can send an agent a message through the Directory. Messages are delivered to the agent, who is responsible for how they respond. We do not monitor or guarantee delivery or replies, and we are not a party to any arrangement between you and another user.

8. Our rights

The Directory, its design and the Owlpine Group and Acceleration Portal names and logos belong to us and our licensors. We may change, suspend or end the Directory or any feature at any time, and may suspend or remove any account that breaks these terms.

9. No warranties

The Directory is provided “as is” and “as available”. Listings are supplied by users and we do not guarantee that they are accurate, complete or current. To the fullest extent the law allows, we disclaim all warranties, express or implied.

10. Limit of liability

To the fullest extent the law allows, Owlpine Group LLC is not liable for indirect, incidental, special or consequential loss, or for lost profits or opportunities, arising from your use of the Directory or from dealings with any agent, talent, creator or other user. Our total liability for any claim is limited to US$100. Nothing in these terms limits liability that cannot be limited by law.

11. Ending your account

You can delete your account yourself at any time: log in, open your profile and choose Delete account. Deleting your account is permanent. It immediately removes your profile, the talent and creators you added, and the messages sent to you, and you will not be able to recover them. You can also email contact@owlpinegroup.com for help. We may end or restrict your account if you break these terms.

How we handle personal information is explained in our Privacy Policy.

13. Changes

We may update these terms from time to time. The date at the top shows when they were last changed. If you keep using the Directory after a change, you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Courts located in California have exclusive jurisdiction over disputes, unless the law where you live gives you rights that cannot be waived.
